These Terms of Service (“Terms”) govern your access to and use of the AnsrAI website, applications, and AI-powered phone assistant services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Definitions

  • “AnsrAI,” “we,” “us,” or “our” refers to the operator of the Service.

  • “User,” “you,” or “your” refers to any individual or entity accessing or using the Service.

  • “AI” refers to automated systems that generate responses or perform actions without human intervention.

2. Acceptance of Terms

By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms. If you are using the Service on behalf of a business or organization, you represent that you have the authority to bind that entity.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement.

4. Description of the Service

AnsrAI provides an AI-powered phone assistant that may answer calls, interact with callers, provide automated responses, route information, and perform call-related tasks based on user configuration.

The Service relies on third-party providers, including but not limited to telecommunications platforms, artificial intelligence systems, and automation services. We do not guarantee uninterrupted availability, accuracy, or error-free operation.

5. User Responsibilities

You agree to:

  • Use the Service only for lawful purposes

  • Obtain all legally required consent before using the Service to answer, process, or record calls

  • Comply with all applicable local, state, federal, and international laws, including telecommunications and privacy laws

  • Ensure that all data you provide is accurate and lawfully obtained

You agree not to:

  • Use the Service for illegal, deceptive, abusive, or fraudulent activities

  • Use the Service for emergency services or life-critical situations

  • Attempt to reverse engineer, interfere with, or disrupt the Service

  • Impersonate individuals or mislead callers

  • Use the Service in violation of do-not-call, telemarketing, or solicitation laws

You are solely responsible for all activity conducted through your account or use of the Service.

6. AI Limitations and No Professional Advice

The Service uses artificial intelligence and automated systems.

You acknowledge and agree that:

  • AI-generated responses may be inaccurate, incomplete, or inappropriate

  • The Service does not provide legal, medical, financial, insurance, or professional advice

  • You are responsible for independently verifying all AI-generated information

  • AnsrAI makes no guarantees regarding the accuracy, reliability, or suitability of AI outputs

7. Call Handling, Recording, and Legal Compliance

Depending on configuration, the Service may answer, process, analyze, or record phone calls.

You are solely responsible for:

  • Informing callers that they are interacting with an AI

  • Providing legally required call disclosures

  • Obtaining consent for call recording where required

  • Complying with all call recording, TCPA, robocall, telemarketing, and telecommunications laws

AnsrAI does not monitor or ensure your compliance with these laws and is not responsible for violations resulting from your use of the Service.

8. TCPA, Robocalls, and Solicitation Disclaimer

You acknowledge that laws governing automated calls, including the Telephone Consumer Protection Act (TCPA), state telemarketing laws, and do-not-call regulations, may apply to your use of the Service.

You agree that:

  • You are solely responsible for ensuring compliance with all such laws

  • AnsrAI does not provide legal advice regarding calling compliance

  • AnsrAI is not liable for any fines, penalties, or claims arising from your calling practices

9. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and process information. By using the Service, you consent to such processing as described in the Privacy Policy.

10. Sensitive Data and HIPAA Disclaimer

The Service is not designed to store or process protected health information (PHI) or other highly sensitive data unless expressly agreed in writing.

You agree not to submit PHI or regulated sensitive data unless covered by a separate written agreement. AnsrAI is not a HIPAA business associate unless explicitly stated.

11. Paid Services

Certain features require payment and are governed by a separate Customer Agreement presented prior to checkout.

Unless otherwise stated:

  • Fees are non-refundable

  • Pricing may change with notice

  • Failure to pay may result in suspension or termination

In the event of a conflict between these Terms and a Customer Agreement, the Customer Agreement controls for paid services.

12. Intellectual Property

All software, technology, content, trademarks, and branding related to the Service are owned by AnsrAI or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service solely as permitted by these Terms. No ownership rights are transferred.

13. Suspension and Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if:

  • You violate these Terms

  • You misuse the Service

  • Your use poses legal, security, or operational risk

Termination does not relieve you of obligations incurred prior to termination.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANSRAI DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANSRAI SHALL NOT BE LIABLE FOR:

  • INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES

  • LOSS OF PROFITS, DATA, OR BUSINESS

  • ERRORS OR OMISSIONS IN AI OUTPUT

  • THIRD-PARTY SERVICE FAILURES

YOUR USE OF THE SERVICE IS AT YOUR OWN RISK.

16. Indemnification

You agree to indemnify and hold harmless AnsrAI from any claims, damages, liabilities, fines, penalties, or expenses arising from:

  • Your use of the Service

  • Your violation of these Terms

  • Your failure to obtain proper call, recording, or data consent

17. Arbitration and Class Action Waiver

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if eligible.

You waive any right to participate in a class action or representative proceeding.

18. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles.

19. Modifications

We may modify the Service or these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.
